You may always choose not to provide the requested information, but if you do not provide the information, you will not be contacted regarding the merits of your potential claim. Text Messaging Program
ClaimsHero operates a mobile messaging program (the "Messaging Program") subject to these mobile messaging terms and conditions. The Messaging Program and our collection and use of your personal information is also subject to our Privacy Policy and our Terms of Use. By enrolling, signing up, acting now, or using the Service you are agreeing to participate in the Messaging Program and accept and agree to these mobile messaging terms and our Privacy Policy and Terms of Use.
- Messaging Program Description: We may send promotional and transactional mobile messages in various formats through the Messaging Program. Promotional messages advertise and promote our Service and may include new campaigns, news and updates, promotions, other marketing offers, and affiliate opportunities. Transactional messages relate to an existing or ongoing transaction and may include reminders to execute agreements, notifications and updates, reminders, case updates, results, and other transaction-related information. Mobile messages may be sent using an automated technology, including an autodialer, automated system, or automatic telephone dialing system. Message frequency will vary, but will not exceed ten (10) messages per month. You agree that we, our affiliates, and any third-party service providers may send you messages regarding the foregoing topics or any topic and that such messages and/or calls may be made or placed using different telephone numbers or short codes, except in connection with marketing purposes. We do not charge for mobile messages sent through the Messaging Program but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for short message service and multimedia message alerts.
- User Opt-In: By providing your mobile phone number to us, you are voluntarily opting in to the Messaging Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal "Do Not Call" list. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at contact@claimshero.io. Your participation in the Messaging Program does not require that you make any purchase from us and your participation in the Messaging Program is completely voluntary.
- User Opt-Out and Support: You may opt-out of the Messaging Program at any time. If you wish to opt-out of the Messaging Program and stop receiving mobile messages from us, or you no longer agree to these mobile messaging terms, reply STOP to the mobile number the message is sent from. You may continue to receive text messages for a short period while we process your request and you may receive a one-time opt-out confirmation message. You understand and agree that the foregoing is the only reasonable method of opting out. If you want to join the Messaging Program again, reply START and we will start sending messages to you again. For support, email contact@claimshero.io or reply HELP to any mobile message from us. Our mobile messaging platform may not recognize requests that modify the foregoing commands, and you agree that we and our service providers will not be liable for failing to honor requests that do not comply with the requirements in these mobile messaging terms. We may also change the telephone number or short code we use to operate the Messaging Program and we will notify you of any such change. You acknowledge that any requests sent to a telephone number or short code that has been changed may not be received by us and we will not be responsible for failing to honor a request sent to a telephone number or short code that has been changed.
- Disclaimer of Warranty and Liability: The Messaging Program is offered on an "as-is" basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Messaging Program.
- Modifications: We may modify or cancel the Messaging Program or any of its features at any time with or without notice. To the extent permitted by applicable law, we may also modify these mobile messaging terms at any time. Any such modification will take effect when it is posted to our Privacy Policy. You agree to review these mobile messaging terms periodically to ensure that you are aware of any modifications. Your continued participation in the Messaging Program will constitute your acceptance of those modifications.
Information Collection
Information You Provide
We collect information you provide, such as when you submit a potential claim for review. We may use service providers to collect this information. The categories of information we collect and have collected in the last 12 months, include the following:
- Contact Information: your name, e-mail address, phone number, postal address, and similar contact information.
- Demographic Data: demographic information including your age, gender, and state.
- Claim Data: information about your potential claim, such as injury to person or property and associated information, all of which is clearly labeled at the time of collection.
- Content: We collect the content of messages you send to us, such as information about your potential claims, or questions and information you provide. We also collect the content of your communications as necessary to provide you with the Service.
- Sensitive Information: when necessary, with your consent or as otherwise permitted by applicable law, we process health data.
- Identification: To ensure the accuracy and integrity of the information you provide, we may collect copies of your state or government-issued identification. This information is used solely for the purpose of verifying your identity and the details you have submitted to us. The types of identification we may request include, but are not limited to, driver’s licenses, passports, and state identification cards.
You may choose to voluntarily submit other information to us through the Service that we do not request, and, in such instances, you are solely responsible for such information. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information Automatically Collected
Some information - such as your Internet Protocol (IP) address and/or browser and device characteristics - is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
Like many businesses, we also collect information through cookies and similar technologies.
The information we collect includes:
- Log and Usage Data. - To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.

When and With Whom Do We Share Your Personal Information?
Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents ("third parties") who perform services for us or on our behalf and require access to such information to do that work. We have contracts in place with our third parties, which are designed to help safeguard your personal information. This means that they cannot do anything with your personal information unless we have instructed them to do it. They will also not share your personal information with any organization apart from us. - Law Firm Partners. We may share your information with our law firm partners for lead generation services. When you submit information to us regarding a potential claim, we share your information at your direction with our law firm partners who we think may be a good fit to assist you with your potential claims. Our law firm partners may then contact you to verify your information and further evaluate your claims. We are not responsible for how our law firm partners treat your information, and any questions regarding their use of your data should be directed to them, not to us.
- Settlement Administrators. We may share your information with settlement administrators to assess whether you may be eligible to participate in other lawsuits, class actions, or settlements. We will notify you if we identify potential legal claims that you may have a right to pursue. This information is limited to your name and contact details (phone number, email, and address), and any relevant information regarding your interactions with the product or service in question.
Use of Cookies and Other Tracking Technologies
We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.
Data Security
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Withdrawing your consent:If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the "Contact Us" section below.
However, please note that withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Opting out of marketing and promotional communications:You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, replying "STOP" to the SMS messages that we send, or by contacting us using the details provided in the "Contact Us" section below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
Account Information. If you would at any time like to review or change the information in your account or terminate your account, you can contact us using the contact information provided.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Tracking Technologies Choices
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

We will use and retain the collected personal information as needed to provide the Services or for as long as the user has an account with us. Categories A-K information may be used, or disclosed to a service provider, law firm partner or contractor, for additional, specified or non-specified purposes. We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

Children
The Service is not directed to children under thirteen (13) years of age. ClaimsHero does not knowingly collect personal information as defined by the U.S. Children's Privacy Protection Act ("COPPA") from children. If you are a parent or guardian and believe ClaimsHero has collected such information, please contact us as set forth in the section entitled "Contact Us" below. We do not knowingly "sell," as the term is defined under the CCPA, the personal information of minors under 16 years old who are California residents.
International Transfer
We are based in the U.S. and the information we collect is governed by U.S. law. If you are located outside of the U.S., please be aware that the information we collect may be transferred to, stored, used, and otherwise processed in the U.S. and other jurisdictions in accordance with this Privacy Policy, and you agree to such processing. Data protection laws in the U.S. and other jurisdictions may differ from those of your country of residence.
State-Specific Rights
California Residents
California Civil Code Section 1798.83, also known as the "Shine The Light" law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.
If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).
CCPA Privacy Notice
This section applies only to California residents. Under the California Consumer Privacy Act (CCPA), you have the rights listed below.
The California Code of Regulations defines a "residents" as:

Your rights with respect to your personal data
Right to request deletion of the data — Request to delete
You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.
Right to be informed — Request to know
Depending on the circumstances, you have a right to know:
- whether we collect and use your personal information;
- the categories of personal information that we collect;
- the purposes for which the collected personal information is used;
- whether we sell or share personal information to third parties;

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re- identify individual data to verify a consumer request.
Right to Non-Discrimination for the Exercise of a Consumer's Privacy Rights
We will not discriminate against you if you exercise your privacy rights.
Right to Limit Use and Disclosure of Sensitive Personal Information
If the business collects any of the following:
- social security information, drivers' licenses, state ID cards, passport numbers
- account login information
- credit card numbers, financial account information, or credentials allowing access to such accounts
- precise geolocation
- racial or ethnic origin, religious or philosophical beliefs, union membership
- the contents of email and text, unless the business is the intended recipient of the communication
- genetic data, biometric data, and health data
- data concerning sexual orientation and sex life
you have the right to direct that business to limit its use of your sensitive personal information to that use which is necessary to perform the Services.
Once a business receives your request, they are no longer allowed to use or disclose your sensitive personal information for any other purpose unless you provide consent for the use or disclosure of sensitive personal information for additional purposes.
Please note that sensitive personal information that is collected or processed without the purpose of inferring characteristics about a consumer is not covered by this right, as well as the publicly available information.

Verification process
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.
We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.
Other privacy rights:
- You may object to the processing of your personal information.
- You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
- You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.

Within forty-five (45) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions.
Connecticut Residents
This section applies only to Connecticut residents. Under the Connecticut Data Privacy Act (CTDPA), you have the rights listed below. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

Virginia Residents
Under the Virginia Consumer Data Protection Act (VCDPA):
"Consumer" means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.
"Personal data" means any information that is linked or reasonably linkable to an identified or identifiable natural person. "Personal data" does not include de-identified data or publicly available information. "Sale of personal data" means the exchange of personal data for monetary consideration. If this definition of "consumer" applies to you, we must adhere to certain rights and obligations regarding your personal data.
